PELICANGOLD PTY LTD (ABN 59 625 446 844, ACN 625 446 844), of Sydney NSW, trades as A Backpacker's Dream. We are responsible for personal information collected through this website, the A Backpacker's Dream app and the Backpacker Hire app.
This policy explains what we collect, why we collect it, who we share it with, and the choices you have. We handle personal information under the Australian Privacy Principles in the Privacy Act 1988 (Cth).
“We”, “us” and “our” mean PELICANGOLD PTY LTD. “You” means a person who uses the website or either app, including a backpacker, an employer or a host.
Information we collect
What we collect depends on how you use the services. We collect it from you, from your device when you allow it, and from the app stores or payment providers when you buy something.
Account and contact details
- your name, email address and mobile number;
- your country and whether you are using the services as a backpacker or as an employer or host;
- if you are an employer or host, your business name and ABN; and
- sign-in records, including codes we send to your phone so you can sign in.
Profile, visa and listing details
- work and travel preferences, availability, and similar profile details you choose to add;
- visa type and visa expiry date, if you choose to enter them. These fields are optional. We use them only to send the visa reminders you set up and, if you apply for a job, to include them in the profile we send to that employer. They are not visa or migration advice;
- job, stay and hangout listings you post, photos you add, and favourites you save; and
- ratings and reviews you give.
Messages, comments and Hangouts
- messages you send to other users, which we collect and store;
- comments you post on Hangouts, which we collect and store;
- Hangout posts, photos and other content you choose to publish; and
- support requests you send us.
A message can be seen by the people in that conversation. A comment or Hangout post can be seen by other users of the app. We do not read messages and comments as a matter of course. If someone reports content, or we need to look into misuse or a breach of the terms, our staff may review the reported message, comment or post, and the surrounding context needed to deal with that report. We may then remove the content and suspend the account. You can report content and block users in the app.
Precise location
With your permission, the apps collect your precise location: the latitude and longitude from your device. We collect it only while that device permission is on. We use it to show jobs, stays and hangouts near you, and so map features can work. We do not use precise location to advertise to you on other companies’ sites, and we do not sell it.
You can turn precise location off at any time in your device settings. On an iPhone, use Settings, then Privacy & Security, then Location Services. On Android, use the app’s permission settings. If you turn it off, nearby search and map features are reduced or will not work. Turning it off stops further collection. It does not delete location information we have already stored for the purposes above.
Device and technical information
- device or other identifiers, including identifiers your phone, the app or an app store uses to recognise the device or the installation;
- push-notification tokens, so we can send notifications you have allowed; and
- diagnostic and security information, such as app version, sign-in failures and records that help us detect misuse.
Payments
Subscriptions bought in the apps are billed by Apple or Google. Subscriptions bought on the website are billed by Stripe. We receive subscription and transaction status from them, such as whether a subscription is active and when it renews. We do not receive or store your full payment-card number. Apple, Google and Stripe handle the card details under their own terms and privacy policies.
What we do not collect
We do not ask for your date of birth, passport, other identity document or tax file number. Please do not send those to us, and do not upload them to a listing, a message or a hangout. We do not sell personal information.
Why we use it
We use personal information to:
- create and manage your account, and sign you in (including by SMS code);
- show jobs, stays and hangouts near you, using precise location when you have allowed it, and run maps and the other features of the apps and the website;
- deliver and store the messages and comments you send, and show Hangout posts to other users;
- send your application profile to an employer when you apply for a job;
- send visa reminders you set up, based only on the visa type and expiry date you enter;
- calculate and display ratings;
- send service and account messages you need in order to use the services;
- send marketing only if you have opted in;
- provide support;
- process and check subscriptions and other payments;
- protect users, investigate misuse and keep the services secure;
- meet our legal obligations; and
- understand faults and improve the reliability of the services.
We do not use visa details to give immigration advice, and we do not use them to decide whether you can work. Checking work rights is a matter for the employer and for you.
Applying for a job
When you tap to apply for a job, we send your application profile to that employer. That is a core part of the service. Each time you apply, you agree to that disclosure.
The profile we send includes the details needed for the application, such as your name, email address, mobile number, visa type and expiry date if you have entered them, and the other profile fields you have filled in. We do not send identity documents, because we do not collect them.
The employer then handles your information for its own purposes, including to decide whether to contact you. That employer has its own privacy obligations. We do not control what the employer does with the profile after we have sent it. Our terms require employers to use application information only to assess and manage the application, and to follow the Privacy Act where it applies to them.
When information is shared
Information you choose to publish, such as a listing, a Hangout post, a comment or a rating, can be seen by other users of the relevant app. A message can be seen by the people in that conversation. Our staff may review a message, comment or post when it is reported, or when we are investigating a breach of the terms.
We also share personal information with service providers who help us run the services. They may use it only to perform those services for us. The providers we use include:
- Amazon Web Services, to host and store the services in Sydney, Australia;
- Twilio, to send SMS, including sign-in codes and marketing SMS you have opted in to;
- Stripe, to take subscription payments on the website;
- Apple, for the App Store, in-app purchases and, where you allow them, Apple push notifications; and
- Google, for Google Play, in-app purchases and, where you allow them, Google push notifications.
If a map is shown in an app, the map provider (such as Apple or Google) receives the location information needed to draw that map, under its own privacy policy.
We may also disclose personal information where the law requires it, where it is needed to protect a person or the services, or as part of a sale or transfer of the business. If the business moves to a related company or a buyer, your information may move with it. We will tell you about that kind of change. The recipient will need to handle the information in line with this policy, or a policy that protects it to the same standard.
We do not sell personal information.
Where we store information, and overseas disclosure
We store personal information in our systems with Amazon Web Services in Sydney, Australia (the ap-southeast-2 region). Primary storage is in Australia.
Some service providers may still process personal information outside Australia, including in the United States. Under Australian Privacy Principle 8, those disclosures include:
- Twilio, for SMS, including sign-in codes and marketing SMS you have opted in to;
- Stripe, for subscription payments made on the website;
- Apple, for App Store purchases and, where you allow them, push notifications; and
- Google, for Google Play purchases and, where you allow them, push notifications.
Those providers, and similar providers we use for the same kinds of tasks, may also use facilities or subprocessors in other countries. Where we disclose personal information overseas, we take reasonable steps so that the recipient handles it in a way that is consistent with the Australian Privacy Principles. Overseas laws can differ from Australian law, including laws that allow government access.
Marketing and service messages
We do send marketing by email and by SMS. We send it only with your consent. At sign-up, marketing is a separate choice from the terms and this policy, and the box is unticked:
- Required: “I’m 18 or over and agree to the Terms of Use and Privacy Policy.”
- Optional, unticked unless you tick it: “Send me news and offers by email or SMS. I can unsubscribe any time.”
Agreeing to the terms or to this policy is not consent to marketing. You can withdraw marketing consent at any time. Withdrawing it does not affect the service messages described below.
Every marketing message identifies A Backpacker's Dream (PELICANGOLD PTY LTD). A marketing email includes a working unsubscribe link. A marketing SMS tells you that you can opt out by replying STOP. We honour unsubscribe and STOP requests within 5 business days, and we do not charge you to opt out. This is how we meet the Spam Act 2003 (Cth).
Service messages are separate from marketing. Visa reminders, sign-in codes, account notices and messages about an application are service messages. They do not include promotions, and they are not an opportunity to add marketing. You can turn visa reminders and many other notifications off in the app or in your device settings. Sign-in codes stay on while the account is open, because they are how we sign you in.
Cookies and the website
This website does not use analytics cookies or advertising cookies, and we do not run a third-party analytics tool on the website. We do not use cookies to follow you around other websites. The pages are static. Your browser may store them in its ordinary cache.
The apps may collect the device identifiers and diagnostic information described above so they can run, sign you in and fix faults. That is not website advertising tracking.
If we later add analytics or advertising cookies, we will update this policy first and, where the law requires it, ask you before they are set.
Security and data breaches
We use safeguards that are reasonable for the information we hold. They include limits on who can access personal information, and encryption when information travels between your device and our servers. No method of storage or transmission is completely secure. Please keep your phone and your sign-in codes to yourself.
If we suspect a data breach that is likely to result in serious harm, we will assess it and, where the Notifiable Data Breaches scheme requires it, notify you and the Office of the Australian Information Commissioner (OAIC).
How long we keep it
We keep personal information while your account is active and while we need it for the purposes in this policy, including to provide the services, resolve disputes, prevent misuse and meet legal obligations.
When you delete your account, we delete or de-identify the personal information in that account within 30 days, except records we are required by law to keep. Those records can include transaction records we must hold for tax or accounting. We keep those only for the period the law requires, and we limit access to them.
Content you had already sent to another user, or that another user had copied, can remain with that user. Backups are overwritten in the ordinary course of operating the services.
Access, correction and deletion
You can update some profile details and notification choices in the app. You can also ask us to give you access to the personal information we hold about you, or to correct it if it is wrong, out of date or incomplete. Email admin@abackpackersdream.com.au. We will respond within 30 days. We may need to confirm that the request comes from you.
If we refuse access or a correction, we will tell you why, unless the law says we should not, and we will explain how you can complain.
You can delete an account yourself:
You can also email us and ask us to delete personal information we no longer need. We will do that unless a law requires us to keep it. Turning off a device permission, such as location, stops further collection of that kind. It does not erase information already collected.
Ratings and rankings
We use computer programs to calculate the average of user ratings and to order search results. A listing with no user ratings is labelled “Not yet rated”. That label is not a review.
These programs do not decide your visa, your pay, whether an employer must hire you, or whether a venue must host you. Employers and venues make their own decisions. A rating is the opinion of the users who left it, not our opinion.
If you think a rating display or a search ranking has treated you unfairly, email us and ask for a review. We will look at it and respond within 10 business days. The terms explain how ratings work and how an employer or host can appeal a rating.
18 and over
The website and both apps are for people aged 18 and over. We do not knowingly collect personal information from anyone under 18. If we learn that we have, we will delete it and close the account.
Changes to this policy
We may update this policy when our services or our legal duties change. The date at the top of this page is the date the latest version took effect.
For a material change, we will give you at least 30 days’ notice in the app or by email before it applies, unless we need to change the policy sooner to meet a legal obligation or to deal with a security or safety issue. If we must move faster, we will tell you as soon as we reasonably can. If you do not agree with a material change, you can close your account before it applies, using the deletion links above or the controls in the app.
We will not describe a change as minor if it reduces your privacy rights or starts a new kind of collection or disclosure.
Complaints
If you have a privacy complaint, email admin@abackpackersdream.com.au with “Privacy complaint” in the subject. Tell us what happened and how we can contact you. We will acknowledge the complaint and respond within 30 days.
If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner:
- website: oaic.gov.au
- phone: 1300 363 992
Please contact us first so we have a chance to fix the problem.
